The Bush administration's declaration that it has unilateral power to designate citizens and non-citizens alike as "enemy combatants," and imprison them without charge or trial was challenged as unconstitutional in a federal court decision on June 11. The Fourth Circuit Court of Appeals in Richmond, Va., in a two-to-one ruling, ordered the government to either charge Ali Saleh Kahlah al-Marri with an alleged terrorist crime in a civilian court or release him. The government plans to appeal the decision to the full court. Al-Marri, in the U.S. legally on a student visa, was arrested in December 2001 and accused by the government of being part of an al-Qaeda sleeper cell on the basis of information provided by Khalid Sheik Mohammed, architect of the Sept. 11, 2001 attacks. The Qatari national has been held in a naval brig in Charleston, S.C. for the past four years. U.S. Circuit Judge Diana Gribbon Motz wrote for the majority, "To sanction such presidential authority to order the military to seize and indefinitely detain civilians . . . would have disastrous consequences for the Constitution -- and the country." Inspired by the Freedom Summer campaign of the Civil Rights era, a coalition of groups from across the U.S. will field 100 organizers to apply political pressure on Republican members of Congress for their ongoing support for President Bush's Iraq war policies. The campaign dubbed, "Iraq Summer, " is being supported by a coalition of peace groups, labor unions, veteran's organizations and Moveon.org. Iraq Summer will target nine GOP Senators and 31 members of the House in 15 states who have backed President Bush's escalation of the war and voted against legislation mandating a timetable for the withdrawal of U.S. troops from Iraq. The campaign cites recent public opinion polls which have found that more than 60 percent of Americans support a plan for withdrawal by 2008. The organizers will spend ten weeks in 40 congressional districts working with local groups to plan letter-writing campaigns, public outreach, press conferences and accountability meetings with legislators. The campaign will culminate with large nationwide anti-war rallies at the end of August, just before Congress is set to vote on new funding for the Iraq war. Congress, under Democratic leadership, is now considering an energy bill whose emphasis differs greatly from legislation passed in 2005 by the Republican-controlled Congress, which favored the oil and gas industry and nuclear power. The new bill leans more toward fuel economy, energy efficiency and renewable energy, but plenty of problems remain. The bill was designed to move the U.S. toward energy independence and away from foreign oil, but some of its provisions would actually greatly increase greenhouse gases, thus worsening the critical problem of global warming. Provisions of the bill would end some tax breaks for big oil companies and make price gouging on oil and gas a federal crime. But lawmakers with ties to the auto industry are attempting to weaken increased mileage standards, while legislators from coal states are working to mandate the production of billions of gallons of gasoline made from coal, a process that environmentalists say will result in a massive rise in carbon emissions. Between The Lines' Melinda Tuhus spoke with Erich Pica, director of domestic campaigns for Friends of the Earth. He discusses the plusses and minuses of the energy bill and what his organization would like to see in forward-looking energy legislation.
