Effort to Restore Habeas Corpus Rights
to Guantanamo Detainees Fails in Senate

Interview with Jennifer Daskal,
U.S. advocacy director of Human Rights Watch,
conducted by Scott Harris

gitmo

For more than five years, hundreds of detainees designated as "enemy combatants" have been held at the U.S. government's Guantanamo Bay detention center in Cuba. Although there has been international condemnation of the facility for holding prisoners without charge or trial, President Bush has refused to close Guantanamo down.

After the U.S. Supreme court ruled in 2004 that these prisoners could challenge their detention in U.S. courts, President Bush worked with the GOP-controlled Congress to pass legislation in 2006 that revoked these detainees' habeas corpus rights and prohibits them from seeking redress regarding maltreatment and torture. A special military appeals court recently overturned a lower court ruling that had blocked military tribunals for 340 Guanatanamo prisoners from going forward.

With Democrats winning control of Congress last November, there was some hope that new legislation could be passed that would restore habeas rights to Guantanamo prisoners. But on Sept. 19, the U.S. Senate sustained a Republican filibuster preventing a vote on the Habeas Corpus Restoration Act as an amendment to the 2008 Defense Department Authorization bill. The final vote was 56-43, with every Democrat and six Republicans voting for the bill. Sen. Joseph Lieberman, D-Conn. was the only non-Republican to vote against the measure. Between The Lines' Scott Harris spoke with Jennifer Daskal, U.S. advocacy director with Human Rights Watch, who explains the uncertain status of efforts in Congress and the Supreme Court to restore habeas corpus rights to Guantanamo detainees.

Anti-Abortion Movement Split on Tactics
to Overturn Roe v. Wade

Excerpt of address by Reva Siegel,
Yale law professor,

produced by Melinda Tuhus

abortion

A forum held at Yale University Law School on Sept. 20 was titled, "What remains of Roe v Wade? Reproductive Justice after the Federal Abortion Ban." The forum addressed the state of the pro-choice movement after the Supreme Court ruled last April in Gonzales v. Carhart that the so-called partial birth abortion ban is not unconstitutional, even though it includes no exception for a woman's health.

Many pro-choice activists fear that the Gonzales v. Carhart decision is an invitation to state legislatures around the country to pass more restrictions on women's reproductive freedom, and that it won't be too long before the Supreme Court will reconsider the core protections of Roe v. Wade.

One of the speakers at the forum, Yale Law School professor Reva Siegel, has studied the history of the anti-abortion movement and related legal cases. In her talk, she addressed two main points. She discussed how anti-choice forces have adopted the language of feminists on protecting a women's health and freedom of choice and reversed the meaning to promote an end to legal abortion as the way to protect women's health and welfare. Professor Siegel also looked at the two wings of the anti-abortion movement -- the absolutists and the incrementalists. The following excerpt from her talk addresses this issue.

Rising Inequality in U.S.
Hurts the Middle Class

Interview with economist Robert Frank,
conducted by Scott Harris

wealthgap

Increasingly, the United States is becoming a land divided by an ever-widening gap between the rich and poor. In the period between World War II and 1979, the expanding U.S. economy helped families in all classes increase their income. But since 1979, America's wealthiest families have seen the largest share of growth in their earnings. In 1980, the richest 5 percent of Americans held 16.5 percent of the nation's income; in 1990 they held 18.5 percent and the latest Census figures for 2005 show that this group has now increased its control of the nation's income to 22.2 percent.

With the very wealthy setting the tone for the ownership of status symbols such as houses, cars and other luxury goods, middle-income families are being induced to spend greater amounts of their near-stagnant incomes to re-establish their economic rank in America's competitive society.

In his new book, "Falling Behind, How Rising Inequality Harms the Middle Class," Cornell University economist Robert Frank investigates the costs of this competition that includes increased work hours and decreased savings rates. Between The Lines' Scott Harris spoke with Robert Frank about the conclusions he's reached on how inequality has reduced the quality of life for America's middle class.
