In the tug of war between the White House and Congress over President Bush's warrantless surveillance program, it appears that the Democrats, who control both the House and Senate, have blinked. On June 20, the House passed an amendment to the Foreign Intelligence Surveillance Act by a vote of 293 to 129. The act grants sweeping new powers to the executive branch to collect data on overseas phone calls and email and provides retroactive immunity to telephone companies that participated in the president's wiretap program. If signed into law, 47 pending lawsuits filed against phone companies for their role in the spy program would be thrown out of court.

The so-called compromise bill was seen by many critics as a Democratic party surrender to the Bush administration's use of fear tactics, charging legislators who opposed the bill as "being soft on terrorism" in an important election year. Many supporters of Barack Obama, the presumptive Democratic presidential candidate, were upset by his change in position on the bill. Sen. Obama had initially opposed granting retroactive immunity to telecommunication companies involved in the spy program, but now says he will support the compromise measure when it comes up for a vote in the Senate.

Between The Lines' Scott Harris spoke with Kevin Bankston, senior staff attorney with the Electronic Frontier Foundation, which has a pending class action lawsuit against phone company giant AT&T for their role in illegally allowing the NSA to monitor customer phone and email communications. Bankston discusses the failure of the FISA legislation to impose meaningful judicial oversight on the government's power to spy on Americans and hold government officials and corporations accountable for breaking the law.

With oil being traded at over $140 a barrel, and gasoline selling for more than $4 a gallon, energy issues have risen to the top of the agenda in this year's presidential election campaign. John McCain and other Republicans are advocating the scrapping of environmental regulations to begin drilling for oil offshore and in the Arctic National Wildlife Refuge, as well as building new nuclear power plants. Democrat Barack Obama is pushing for increased national fuel efficiency standards to reduce consumption and greenhouse gas emissions, while pledging to invest in new research to develop renewable energy sources.

One of the most promising and limitless renewable energy sources, solar power, is growing in the U.S., but is still just a tiny fraction of the total energy mix, dwarfed by fossil fuels like coal, oil and natural gas. Energy researchers say that solar will need serious government support to become a viable alternative. But two recent developments have set up potential roadblocks. One, Congress must vote by the end of the year to extend the solar investment tax credits that have helped the industry grow, or they will expire. And two, the Bush administration just declared a moratorium on new solar projects on public lands, while it conducts environmental impact studies on the 130 applications for solar power plants already received.

Between The Lines' Melinda Tuhus spoke with Kate Johnson, a member of the Sierra Club's global warming and energy team. She describes the hurdles that solar energy companies face, the preferential treatment the fossil fuel industry receives from the Bush administration, and legislation pending in Congress that could improve solar's chances for viability.

Diebold Whistleblower Has
Grave Concerns About
2008 Election Integrity

While working as a word processor in a California law office in January 2004, Steve Heller made a fateful decision to steal and publicly reveal legal documents proving that Diebold Election Systems Inc. was using illegal, uncertified software in their California voting machines.

Four months later, based partly on the information that Heller released, then California Secretary of State Kevin Shelley de-certified Diebold voting machines, for what he charged was the company's, "fraudulent," "despicable" and "deceitful behavior." For his theft of the legal documents from the law firm representing Diebold, Heller was charged with 3 felonies, fined $10,000 in restitution - and placed on probation for three years.

After observing what he believed to be blatant examples of voter suppression in Ohio, during the 2004 presidential election, Heller dedicated his time and energy to exposing violations of the Voting Rights Act and protecting the integrity of future elections. He has recently served as a consultant to Dennis Kucinich on the Ohio Congressman's filing of 35 Articles of Impeachment against George W. Bush. Between The Lines' Scott Harris spoke with Steve Heller, who recounts his experience as an election protection whistleblower, and his concerns about the integrity of election machinery in this year's presidential election.
