Interview with John Dean,
After the controversial tenure and resignation of U.S. Attorney General Alberto Gonzalez in August, President Bush nominated Michael Mukasey, a U.S. District Court Judge from New York to fill the post. During his Senate confirmation hearings, Mukasey was asked whether waterboarding was torture. Waterboarding used during the Spanish Inquisition, by the Nazis and Cambodia's Khmer Rouge simulates drowning by shackling and pouring water over the face of the subject whose face is covered with cloth or plastic. U.S. interrogators are reported to have used this technique in an effort to extract information from high-level terrorist suspects. Mukasey failed to clearly give his view of waterboarding after repeated questions in Senate hearings. When Democrats asked him for an answer in writing, Mukasey responded with a letter stating that waterboarding seemed "over the line" and was "repugnant, but declined to declare it illegal. In a letter to Senate Judiciary Committee Chairman Patrick Leahy, four retired Judge Advocates General -- the judicial arm of the U.S. military -- sharply criticized Judge Mukasey's equivocation. They unambiguously state that waterboarding is torture. Despite Mukasey's disturbing indication that he would continue to allow the Bush administration to employ torture banned by U.S. and international law, Mukasey's nomination was endorsed by the Senate Judiciary Committee in an 11 to 9 vote on Nov. 6. Democratic Sens. Chuck Schumer of New York and Dianne Feinstein of California joined all nine Republicans in support of Mukasey while all other Democratic senators voted no. Mukasey is now expected to be confirmed by the full Senate. Between The Lines' Scott Harris spoke with John Dean, former Counsel to President Nixon and key figure in the Watergate scandal, who discusses the breakdown of government process and accountability surrounding the nomination of Michael Mukasey as attorney general.
