An important Justice Department legal memorandum sheds light on the Bush administration's authorization of abuse and torture of U.S. held prisoners at Abu Ghraib prison in Iraq, in Afghanistan and Guantanamo Bay, Cuba. The document was made public on April 1. The memo, written in March 2003, was released after the American Civil Liberties Union requested it be declassified under the Freedom of Information Act.

The memo, written by John Yoo, then a deputy at the Department of Justice Office of Legal Counsel, asserts that President Bush has unrestricted authority to order brutal interrogations to extract information from detainees and was provided to the Defense Department in March 2003. A similar memo was sent to the CIA in August 2002 which narrowly re-defined torture as methods that result in pain akin to that associated with "death, organ failure or the permanent impairment of a significant body function." Although both these memos were formally withdrawn by the Justice Department in 2004, critics assert that the legal arguments they made helped institute a culture that condoned torture within the Pentagon and CIA.

The legal document also maintained that any government agent who engaged in torture and abuse, prohibited by U.S. or international law, could defend themselves from prosecution on the basis that that the executive branch's constitutional authority to protect the nation from attack justified their actions. Between the Lines' Scott Harris spoke with Jameel Jaffer, director of the American Civil Liberty Union's National Security Project. He discusses what the memo tells us about the role the Bush administration played in sanctioning torture and what Congress can do to hold government officials accountable for possible war crimes.

As the Iraq War entered its sixth year, estimates range up to 1 million Iraqis dead. More than 4,000 U.S. soldiers have been killed, with another 30,000 wounded thus far in the conflict. During testimony on Capitol Hill on April 8th, Army Gen. David Petraeus and U.S. Ambassador Ryan Crocker told legislators that security has improved and steps toward political reconciliation have been made. But the reality on the ground in Iraq contradicts the happy talk coming from administration officials. A recent spike in violence resulting from intense fighting between the poorly performing Iraqi Army and militias loyal to Shiite cleric Muqtada al-Sadr has cast doubt on White House proclamations that "the surge has worked."

As the casualties on all sides mount, the grim reality of the Iraq war has been hidden from the view of most Americans -- with photographs of returning caskets of U.S. soldiers banned, and the shattered lives of maimed and disfigured veterans largely forgotten. A new documentary film, recently released titled "Body of War," follows the life of Tomas Young, a 25-year-old U.S. Army Iraq War veteran, who returned home paralyzed and wheel-chairbound, later finding his voice as an anti-war activist.

The film provides an unvarnished look at the daily physical and emotional pain suffered by Young and other veterans, who sustained life-changing injuries in a war launched on a set of blatantly false justifications. Between The Lines' Scott Harris spoke with Emmy and Peabody award-winning TV talk show host Phil Donahue, co-director with Ellen Spiro of this critically acclaimed documentary film. Donahue talks about how he met Tomas Young at Walter Reed Hospital and the message he'd like audiences to take from the film.

Drug Companies Pushing
for Immunity from Patient Lawsuits

The U.S. Food and Drug Administration is charged with safeguarding the American public from an increasing number of toxic food outbreaks and dangerous prescription and over the counter drugs. It's also responsible for regulating medical devices, dietary supplements and cosmetics. The agency has been criticized for both over-regulating, and under-regulating some drugs. AIDS activists, for example, have demanded that new medicines to treat HIV infections be approved quickly even if they hadn't been thoroughly tested in clinical trials. Other critics charge the FDA with being too cozy with pharmaceutical companies for under-regulating some medicines they approved, but later implicated in the deaths or injuries of patients.

Now drug companies are pushing the FDA to grant them immunity from lawsuits filed by patients or their families when they suffer injury or death from taking medications as directed. A case is now headed to the U.S. Supreme Court on this issue that could impact thousands of pending consumer lawsuits.

Between The Lines' Melinda Tuhus spoke with Merrill Goozner, director of the Integrity in Science Project at the Center for Science in the Public Interest. He discusses the history of the FDA and how those most influential in decision-making at the agency are often at odds with consumers' interests.
